Terms of Use

The services provided by AirPhoto to you are subject to the following terms of use. If you do not agree, do not access or use the services provided by AirPhoto. By accessing or using the AirPhoto website, AirPhoto services, or any application provided by AirPhoto (including mobile applications) (collectively referred to as "services").

AirPhoto reserves the right to update and modify the terms of use at any time without notifying you. Using AirPhoto after the change of the terms of use is deemed as your agreement and acceptance of the change.

AirPhoto Terms of Use

Basic Terms

1. You may not use AirPhoto to publish, transmit, spread, or store content that violates national laws, endangers national security, national unity, social stability, public order and good customs, or any inappropriate, defamatory, obscene, violent, or content that violates national laws, regulations and policies, or content that infringes on the legitimate rights of others such as intellectual property rights, trade secret rights, and privacy rights. Nor may you transmit or distribute files containing images, photos, software, or other materials protected by intellectual property laws in any other way, unless the user owns or controls the corresponding rights or has obtained all necessary approvals.

2. You are responsible for any activities that occur through your account, and you agree not to sell, transfer, license, or transfer your account or any account rights. Except for individuals or enterprises explicitly authorized to create accounts on behalf of their employers or clients, AirPhoto prohibits creating accounts, and you agree not to create accounts for anyone other than yourself. You also declare that all information provided or to be provided by you to AirPhoto at the time of registration and at all other times is true, accurate, up-to-date, and complete, and you agree to update your information as necessary to maintain its truthfulness and accuracy.

3. You agree not to request, collect, or use the login credentials of other AirPhoto users.

4. You are responsible for properly safeguarding your password.

5. You may not slander, stalk, bully, insult, harass, threaten, impersonate, or intimidate others or entities, and you may not publish private or confidential information through AirPhoto, including but not limited to your or anyone else's credit card information, social security or alternate identification numbers, non-public phone numbers, or non-public email addresses.

6. You may not use AirPhoto for any illegal or unauthorized purposes.

7. You are fully responsible for any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, copyrighted works, applications, links, and other content or materials (collectively referred to as "content") that you submit, publish, or display on AirPhoto.

8. You may not alter AirPhoto or change other websites to falsely imply an association with AirPhoto.

9. You may not access AirPhoto's private API in any way other than those permitted by AirPhoto.

10. You may not create or submit unwanted emails, comments, or other forms of commercial or harassing communications (also known as "spam") to any AirPhoto user.

11. Without the prior written consent of AirPhoto, you may not use domain names or website URLs in your username.

12. You may not interfere with or disrupt AirPhoto or the servers or networks connected to AirPhoto, including transmitting any worms, viruses, spyware, malware, or any other destructive or harmful code. You may not inject content or code or otherwise change or interfere with the presentation or display of any AirPhoto page in a user's browser or device.

13. You may not create an account with AirPhoto in an unauthorized way, including but not limited to using automated devices, scripts, robots, spiders, or crawlers.

14. You may not attempt to limit other users' use or enjoyment of AirPhoto, and you may not encourage or promote violations of these terms of use or any other AirPhoto terms.

15. Violations of these terms of use may result in the termination of your AirPhoto account at AirPhoto's sole discretion. You understand and agree that AirPhoto cannot and will not be responsible for the content posted on this service, and you bear the risk of using AirPhoto. If you violate the letter or spirit of these terms of use, or otherwise pose a risk or potential legal risk to AirPhoto, we may stop providing all or part of the service to you.

16. You agree to indemnify AirPhoto for any requests, losses, liabilities, claims, or expenses (including attorney's fees) made by any third party against AirPhoto arising from or related to your use of AirPhoto.

General Terms

Retention of Rights

1. AirPhoto reserves the right to take the following actions at any time without notice:

• We reserve the right to suspend or terminate the operation and access of AirPhoto at any time for any reason without notice and without any liability to you.
• Modify or change all or part of AirPhoto's content and its applicable policies or terms.
• Interrupt all or part of the operation and access of AirPhoto when necessary for regular or irregular maintenance, error correction, or other changes.

2. Once terminated, all licenses and other rights granted to you under these terms of use will immediately terminate.

3. We reserve the right to deny anyone access to AirPhoto for any reason at any time.

4. We reserve the right to confiscate any username for any reason at any time.

5. We may delete, edit, or monitor content or accounts that violate these terms of use.

7. You are fully responsible for your interactions with other users of AirPhoto, whether online or offline. You agree that AirPhoto is not responsible for or obligated for the actions of any user. AirPhoto reserves the right but has no obligation to participate in disputes between you and other users. Use common sense and best judgment when interacting with others, including when submitting or posting content or any personal or other information.

8. There may be links in communications from AirPhoto or that you receive from AirPhoto to third-party websites or functions. If you decide to visit or use a linked website, you do so entirely at your own risk. Images or comments in AirPhoto may also contain links to third-party websites or functions. AirPhoto also includes third-party content that we cannot control, maintain, or endorse. The functions of AirPhoto may also allow interaction between AirPhoto and third-party websites or functions, including applications that connect AirPhoto or your profile on AirPhoto to third-party websites or functions. AirPhoto does not control any of these third-party network services or any of their content. You expressly acknowledge and agree that AirPhoto is not responsible for any such third-party services or functions. Your communications and transactions with third parties through AirPhoto are solely between you and the third party, and you decide and bear the risk.

9. You agree that you are responsible for all data charges resulting from your use of AirPhoto.

10. We prohibit accessing any content on AirPhoto by automated means such as crawling, scraping, caching, or otherwise, including but not limited to user profiles and photos (unless it may be the result of standard search engine protocols or technologies used by search engines and with the explicit consent of AirPhoto).

AirPhoto expressly disclaims any responsibility or obligation to any individual or entity for any loss, damage (whether actual, consequential, punitive, or otherwise), injury, claim, liability, or other cause based on any content or arising from any content of any kind or nature.

AirPhoto makes no representations or warranties as to the accuracy, completeness, or usefulness of the information on this service (including any descriptions). You acknowledge that the risk of using AirPhoto is borne by you. AirPhoto does not guarantee that your use of this service is legal in any particular country or region, and AirPhoto expressly disclaims any such guarantee.

By accessing or using AirPhoto, you represent and warrant that your activities are legal in the country or region where you access or use AirPhoto.

AirPhoto expressly disclaims any responsibility or obligation to any individual or entity for any loss, damage (whether actual, consequential, punitive, or otherwise), injury, claim, liability, or other cause based on any content or arising from any content of any kind or nature.

AirPhoto does not represent or warrant that the service is free of errors or will not be interrupted; or that the service or server provided does not contain any harmful components, including but not limited to viruses. AirPhoto makes no representations or warranties as to the accuracy, completeness, or usefulness of the information on this service (including any descriptions). You acknowledge that the risk of using AirPhoto is borne by you.

In no event shall AirPhoto be liable to you for any direct or indirect loss or damage (including but not limited to any direct, indirect, economic, disciplinary, special, punitive, accidental or consequential loss or damage) related to: (i) the service; (ii) AirPhoto content; (iii) user content; (iv) your use, inability to use or performance of the service; (v) any action related to an investigation by AirPhoto or law enforcement agencies of your or any other party's use of the service; (vi) any action related to copyright or other intellectual property owners; (ix) any errors or omissions in the operation of the service; (x) any damage to any user's computer, mobile device or other device or technology, including but not limited to damage caused by any security vulnerability or any virus, bug, tampering, fraud, error, omission, interruption, defect, operation or transmission delay, computer line or network failure or any other technical or other failure, including but not limited to damage caused by loss of profit, loss of goodwill, loss of data, downtime, accuracy of results or computer failure or malfunction, even if foreseeable, or even if AirPhoto has been notified or should have known of the possibility of such damage, whether in contract, negligence, strict liability or tort (including but not limited to that caused in whole or in part by negligence, force majeure, telecommunications failure, service theft or destruction). In no event shall any party of AirPhoto be liable for your or any other person's loss, damage or injury, including but not limited to death or personal injury. In no event shall AirPhoto's total liability for all your damages and losses exceed the price you paid for ordering AirPhoto services or features.

Applicable Law and Dispute Resolution

You agree that all matters related to your access to or use of AirPhoto shall be interpreted, understood and governed in accordance with the laws of the People's Republic of China. In the event of a dispute between AirPhoto and you regarding the conclusion, performance or interpretation of these terms of use, all parties shall endeavor to resolve it through friendly consultations. If the consultations fail, you agree that the people's court at the place where AirPhoto is domiciled shall have jurisdiction over the disputes or controversies among all parties.
